1. Acceptance of terms

By downloading, installing, or using Mend, you accept these Terms of Use in full. If you do not agree with any of these terms, do not use the app.

2. Description of the service

Mend is an AI-powered communication and relationship coaching app. It provides emotional support, communication tools, and support during moments of conflict or emotional crisis through three modules: Coach, Now, and Your Ritual.

Important notice — Not a mental health service:
Mend is a support and coaching tool, not a medical, psychological, or psychiatric service. Conversations with Mend do not constitute therapy and do not replace care from a mental health professional.

If you are in an emergency or a situation that puts your life or others' lives at risk, contact your country's emergency services immediately:

3. Eligibility

To use Mend you must:
- Be at least 18 years old
- Have the legal capacity to accept these terms in your jurisdiction

Mend is intended exclusively for adults. We do not offer the service to anyone under 18.

4. User account

You can use Mend without creating an account. If you save your account:

You are responsible for keeping your account and password secure
You may not share your account with third parties
You may not create accounts in an automated or bulk manner
You must notify us immediately if you detect unauthorized access to your account: support@mymend.app

5. Acceptable use

Allowed:
- Using Mend for your personal wellbeing and to improve your communication
- Accessing the service from your own devices
- Sharing your experience with Mend (without disclosing others' private conversations)

Prohibited:
- Using Mend for illegal activities or activities that harm others
- Attempting to access other users' data or conversations
- Reverse-engineering, decompiling, or modifying the app
- Using bots, scripts, or unauthorized automation
- Posting or sharing content that promotes violence, hatred, or illegal activities
- Impersonating any person or entity
- Using the service to harass, threaten, or harm others

6. Artificial intelligence

Mend uses artificial intelligence (Anthropic Claude) to generate coaching responses. You should be aware that:
- AI responses may contain errors or inaccuracies
- The AI has no memory between separate sessions (other than the history saved in the app)
- AI responses do not constitute medical, legal, or financial advice
- Use of the AI is subject to Anthropic's usage policies

7. User content

You retain all rights to the content you share in Mend
By using Mend, you grant us a limited, non-exclusive, revocable license to process your content solely to provide the service
We do not use your content to train artificial intelligence models
We do not share the content of your conversations with third parties, except the providers listed in our Privacy Policy

8. Subscriptions and payments

Trial period:
Mend Premium offers a 7-day free trial for eligible accounts. When it ends, the subscription automatically converts to paid unless you cancel before the trial period expires.

Mend Premium plans:
- Monthly subscription
- Annual subscription

Exact prices are shown in the app at the time of subscription and may vary by region.

Billing:
- Subscriptions are billed automatically according to the chosen cycle
- Payments are processed through the App Store (Apple)
- Prices may change with 30 days' prior notice

Cancellation:
- You can cancel your subscription at any time from your Apple account settings
- Cancellation takes effect at the end of the current billing period
- Cancellation does not generate a refund for the current paid period

Refunds:
Refunds are handled under Apple App Store policy. To request a refund, go directly to Apple.

9. Service availability

We strive to keep Mend available 24 hours a day, but we do not guarantee uninterrupted availability
We may perform scheduled maintenance with prior notice when possible
We are not responsible for interruptions caused by third parties (cloud providers, app stores, etc.)

10. Limitation of liability

To the maximum extent permitted by applicable law:
- The service is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, or consequential damages arising from use of the app
- We are not liable for decisions made based on the AI's responses
- Our maximum liability is limited to the amount paid by the user in the last 12 months

This limitation does not affect consumer rights under applicable Mexican law (Federal Consumer Protection Law).

11. Intellectual property

Mend, its name, design, code, and content are the property of Antonio González
You may not use the Mend brand or any element of the app without written authorization
Content generated by the AI in response to your messages does not constitute transferable intellectual property

12. Termination

By you: You may stop using Mend at any time and delete your account from Settings → Delete account within the app (or Delete my data if you use Mend without an account).

By us: We may suspend or terminate accounts that violate these terms, with prior notice when possible. In cases of serious violations (illegal activities, service abuse), we may act immediately without prior notice.

13. Changes to these terms

We will notify you of material changes at least 30 days in advance through:
- In-app notification
- Email to the address registered with your account (if you have one)

Continued use after the effective date constitutes acceptance of the new terms.

14. Governing law and jurisdiction

These terms are governed by the laws of the United Mexican States. Any dispute shall be submitted to the jurisdiction of the competent courts of Mexico, without prejudice to consumer rights under applicable local law.
